NCCD360 is a core component of the Education360 Suite, proudly delivered by 9X5 Consulting Pty Ltd (ABN 89 639 516 242) (“9X5”, “we”, “our” or “us”). By registering for the 30-day free trial or by accessing and using the NCCD360 platform, you (“you” or “the Client”) confirm your acceptance of the Terms and Conditions set out below, which govern your use of the service and our mutual obligations.
Thank you for choosing NCCD360 part of the Education360 Suite from 9X5 Consulting, a purpose-built platform developed to support schools in meeting their obligations under the Nationally Consistent Collection of Data on School Students with Disability (NCCD). We’re proud to offer a powerful, user-friendly solution that simplifies compliance, strengthens student support, and delivers real-time insights to help your school make informed decisions.
Before you begin your free trial or proceed with continued use of the platform, we kindly ask that you read and understand the Terms and Conditions outlined below. These terms are designed to ensure clarity, transparency, and mutual understanding in how the NCCD360 platform is delivered and supported.
By accessing or using NCCD360, you acknowledge that you have read, understood, and agreed to these Terms and Conditions, and that you are authorised to enter into this agreement on behalf of your school or educational institution.
- Free Trial and Subscription Agreement
Upon registration, the Client (You) will receive access to the NCCD360 platform for a 30-day free trial period at no cost. This trial period is intended to allow your school to evaluate the platform’s suitability for your compliance and operational needs. To avoid automatic enrolment into a paid subscription, the Client (You) must notify Education360 in writing by emailing info@education360.com.au prior to the conclusion of the 30-day trial to cancel your 30-day trial subscription. If no such notice is received, the Client (You) agrees that the school will be automatically enrolled in a 12-month subscription to NCCD360, and an invoice will be issued accordingly based on the number of students currently enrolled at the school. By commencing the free trial, the Client (You) accepts and agrees to the pricing published on the official NCCD360 website, and acknowledges that these prices form part of this legally binding agreement. The Client further agrees that payment for the subscription is due within 14 days of invoicing. This agreement, and any dispute arising in connection with it, shall be governed by the laws of the State of Victoria, Australia, and the parties irrevocably submit to the exclusive jurisdiction of the courts of that State.
- Authority to Enter Agreement
By registering for the NCCD360 free trial or by accessing and using the NCCD360 platform, the Client (You) expressly warrants and represents that you have the full legal authority to enter into this agreement on behalf of your school or educational institution. You further acknowledge that you are authorised to bind the institution to these Terms and Conditions, including all associated payment obligations, subscription renewals, and compliance responsibilities. In the event it is later determined that you did not have such authority, the individual who registered and accepted these terms may be held personally liable for any resulting costs or damages. This agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, and all parties submit to the exclusive jurisdiction of the courts of that State in relation to any disputes arising from or in connection with this agreement.
- Service Level Agreement (SLA)
3.1 Introduction
This SLA outlines the commitments, responsibilities, and expectations between the Client (You) and Education360 regarding NCCD360. As Education360 is a reseller and not the developer of the underlying software platform Domo (the platform powering NCCD360), no liability will be accepted for product errors outside of our control.
3.2 Purpose
The purpose of this Service Level Agreement (SLA) is to establish a clear and consistent framework for the delivery and support of the NCCD360 solution by 9X5 Consulting. It defines the scope of services provided, outlines the expected performance standards, and clarifies the responsibilities of both the Client and the Service Provider. This SLA ensures that both parties have a shared understanding of the commitments involved, including how service performance will be monitored and measured. Ultimately, it provides the foundation for a reliable and transparent partnership focused on supporting schools in meeting their compliance obligations under the Nationally Consistent Collection of Data on School Students with Disability (NCCD), while enhancing student support through the effective use of technology and data.
3.3 Scope of Services
NCCD360 is a comprehensive digital platform developed to support schools in fulfilling their obligations under the Nationally Consistent Collection of Data on School Students with Disability (NCCD). The platform is designed to facilitate data collection, compliance tracking, and reporting through real-time dashboards and analytics, while also integrating with existing school data systems to provide a centralised compliance environment. To ensure the effectiveness of the platform, the following services are included as part of the standard subscription: initial setup and configuration of NCCD360, ongoing software maintenance and system updates, a user training session for staff, access to help desk support during business hours, regular performance reviews, and security monitoring to ensure alignment with data protection and compliance standards. The Client acknowledges that certain services fall outside the scope of the standard offering and will incur additional charges if requested. These excluded services include but are not limited to custom software development or feature enhancements, integration with third-party systems beyond the default configuration, and any on-site technical support or training services. The provision of such excluded services will be subject to a separate agreement and pricing schedule. All services provided under this agreement are subject to the laws of the State of Victoria, Australia, and any related disputes shall be submitted to the exclusive jurisdiction of the Victorian courts.
- Service Performance
NCCD360 is designed to deliver reliable, high-performance access to schools at all times. The platform will be available 24/7, with the exception of scheduled maintenance periods, which will be communicated at least 48 hours in advance and, wherever possible, conducted outside of peak usage hours. To ensure optimal service quality, NCCD360 is maintained to achieve a minimum system uptime of 99.5% per calendar month. In the event of service issues, critical incidents will be acknowledged within one hour and resolved within four hours wherever possible. Non-critical issues will be acknowledged within four hours and resolved within 24 hours. To safeguard school data and maintain compliance integrity, the platform adheres to industry-standard security protocols, including robust data encryption, secure user authentication, and regular security audits.
- Responsibilities
To ensure the successful implementation and ongoing performance of NCCD360, the Client agrees to provide accurate and timely information necessary for the setup and operation of the platform, including a current student list and staff user list in the format provided by Education360. The Client is responsible for ensuring that all authorised users are adequately trained and adhere to security, privacy, and usage guidelines as outlined by Education360. Any issues or concerns encountered with the platform must be reported promptly to ensure swift resolution. Additionally, the Client is expected to maintain the required hardware and network infrastructure, such as end-user devices or tablets to enable reliable access to the NCCD360 solution.
- Monitoring and Issue Management
Education360 continuously monitors the performance and security of NCCD360 to ensure that service levels are consistently met. This includes real-time tracking of system uptime, response times, and adherence to security protocols. Should any issues arise, the Client may report incidents through multiple channels, including email (support@9×5.com.au), telephone (1800 950 667), or via the support portal (details provided post-signup). If an issue is not resolved within the specified response timeframe, it will be escalated through a structured process involving the Help Desk team, the Technical Support Lead, and, if necessary, the Service Delivery Manager. For critical incidents, a formal root cause analysis will be conducted by 9X5 Consulting and a report provided to the Client within five business days of resolution.
- Support and Maintenance
Education360 provides comprehensive support to ensure the effective operation of NCCD360. Help Desk support is available to all clients during standard business hours, from Monday to Friday, 9:00 AM to 5:00 PM AEST, excluding public holidays. Clients can access support services through email, phone, or the online support portal. In addition to responsive support, NCCD360 undergoes routine maintenance to ensure system stability and performance. This includes monthly system checks, quarterly software updates and security patches, and an annual full-system audit. These proactive measures are designed to maintain platform reliability, security, and compliance with evolving requirements, ensuring that schools receive consistent, high-quality service throughout their subscription period.
- Financial Terms
All NCCD360 subscription fees are billed annually in advance and are based on the number of students currently enrolled at the Client’s school. Upon completion of the free trial period unless cancelled in writing, an invoice will be issued for the full 12-month subscription. Payment is due within 14 days of the invoice date. Failure to pay within this timeframe may result in the suspension of service and could incur additional fees. The pricing for NCCD360 is clearly listed on the 9X5 website and is deemed accepted upon registration for the free trial. Annual renewal pricing is subject to adjustment in line with inflation, a 5% increase per year.
- Contract Renewal
The NCCD360 subscription will automatically renew on the anniversary of the initial subscription unless the Client provides written notice of cancellation at least 90 days prior to the renewal date. This auto-renewal process ensures uninterrupted access to the platform and its services. The subscription fee for each renewal term will be calculated based on the current number of enrolled students at the Client’s school. In line with standard industry practice, annual subscription fees is subject to a 5% increase to reflect Consumer Price Index (CPI) increases and rising service delivery costs. It is the Client’s responsibility to review renewal timelines and notify 9X5 Consulting in a timely manner if they do not wish to continue the subscription. Renewal Pricing is based on student enrolment numbers at the time of renewal.
- Support Ticketing
To ensure timely and efficient resolution of service issues, all support requests for NCCD360 should be logged via the Education360 Support Help Desk portal, accessible at https://zoho.com/desk. Clients can create an account to submit tickets and track the progress and resolution of their requests. While the portal is the preferred method for support, clients may also contact the support team by emailing support@9×5.com.au or, in the event that email or internet access is unavailable, by calling 1800 950 667. This multi-channel support system ensures that assistance remains accessible regardless of the situation, providing schools with reliable and responsive technical help throughout their engagement with NCCD360.
- Warranties
Both parties to this agreement warrant that they have the legal authority, power, and capacity to enter into and perform their respective obligations under these Terms and Conditions. Each party also warrants that entering into this agreement does not infringe upon the intellectual property rights of any third party. Education360 warrants that, provided the Client complies with the terms of this agreement, the NCCD360 software will operate in material accordance with its accompanying documentation during the warranty period. This warranty is subject to a number of limitations. It does not apply in cases where issues arise due to third-party platform errors (e.g., from Domo), misuse, failure to follow documented procedures, or unauthorised modifications. Additionally, the warranty is void if the Client fails to maintain reasonable IT security practices, installs the software on unsupported systems, or neglects to apply recommended updates or upgrades. Education360 is not liable for damage resulting from external causes such as natural disasters, power surges, or unauthorised repair attempts. Except as expressly stated in this clause, all other warranties, whether express or implied including those relating to fitness for purpose or performance outcomes are excluded to the maximum extent permitted by law.
- Compliance Disclaimer
While NCCD360 is designed to assist schools in the management and tracking of NCCD applications, including the storage and organisation of associated supporting evidence, the responsibility for ensuring compliance with the Nationally Consistent Collection of Data on School Students with Disability (NCCD) requirements remains solely with the Client (You). NCCD360 is a facilitative tool and does not constitute legal or regulatory advice. By using the platform, the Client acknowledges and agrees that Education360 and 9X5 Consulting Pty Ltd are not responsible for determining whether the Client’s NCCD practices or documentation satisfy applicable government compliance standards. Accordingly, to the maximum extent permitted by law and under the jurisdiction of the laws of the State of Victoria, Australia, Education360 and 9X5 Consulting Pty Ltd accept no liability financial or otherwise for any failure by the Client to comply with NCCD obligations. Use of the NCCD360 platform is at the Client’s own risk, and no warranties or representations are provided as to the compliance status of the data or documentation entered or managed through the platform.
13. Changes to Terms
Education360 reserves the right to amend, update, or modify these Terms and Conditions, including the associated Service Level Agreement, at any time. Any such changes will be published on the official NCCD360 website, and it is the responsibility of the Client (You) to review the Terms periodically for updates. Continued use of the NCCD360 platform after changes have been made constitutes acceptance of the revised Terms and Conditions. If you do not agree to the updated Terms, you must cease use of the platform and provide written notice of termination in accordance with the cancellation provisions set out in this agreement. All changes will be governed by and interpreted in accordance with the laws of the State of Victoria, Australia, and any disputes arising in connection with such changes shall be subject to the exclusive jurisdiction of the courts of Victoria.
